Fayette County Probate Court Office

The Fayette County Probate Court is at 1 Center Drive in Fayetteville. The office handles marriage licenses along with other probate matters. Business hours are Monday through Friday, 8:00 AM to 5:00 PM.

The Administrative Complex is on Center Drive just off Highway 85. Parking is free and plentiful. The Probate Court shares the building with other county departments, so look for signs directing you to the right office.

Fayette County Marriage License Requirements

Both people must come to the Probate Court together. Each needs valid photo ID. Accepted forms include a driver's license, state-issued ID, passport, or military ID. Birth certificates also work as proof of age.

If either applicant has been married before, you must bring proof that the marriage ended. A certified copy of the final divorce decree, annulment, or death certificate is required. The court checks these documents before issuing a new license.

Georgia does not require a blood test. There is no waiting period. The license is issued on the same visit. It does not expire. Georgia residents can get a license in any county. Non-residents must apply in the county where the ceremony will take place.

You must be 18 or older. A 17-year-old may apply with proof of emancipation. The emancipation must have been granted at least 15 days before the application. The other party cannot be more than four years older. No one under 17 qualifies.

After the Wedding Ceremony

The officiant signs the license after the ceremony. Return the signed document to the Fayette County Probate Court within 30 days. The court records it and mails your marriage certificate. Processing takes up to 30 days.
