The Probate Court building on Tara Boulevard is separate from the main courthouse. Make sure you go to the right address. Parking is available in the building lot. The office handles marriages, estates, and other probate matters.
Clayton County Marriage License Requirements
Both people must appear at the Probate Court together. You each need a valid photo ID. Accepted forms include a driver's license, state ID card, U.S. passport, or military ID. The court also accepts birth certificates as proof of age.
If either applicant was married before, bring proof that the marriage ended. A certified final divorce decree, annulment order, or death certificate of the former spouse is needed. The court will verify this before issuing the license.
Georgia has no blood test requirement. No waiting period. The license is issued the same day. It does not expire. Georgia residents can apply in any county in the state. If neither person is a Georgia resident, the license must be obtained in the county where the ceremony takes place.
Applicants must be at least 18. A 17-year-old may apply only with proof of emancipation. At least 15 days must have passed since the emancipation was granted. The other party cannot be more than four years older. No one under 17 is eligible for a marriage license in Georgia.
Marriage License Fees
Clayton County charges $56 for a standard marriage license. With a premarital education certificate, the fee is $16. The course must be at least six hours long and completed within 12 months of the application date. Both applicants attend together.
The program must be taught by a licensed counselor, social worker, therapist, psychologist, psychiatrist, or active clergy member. Bring the certificate when you apply. You cannot get the reduced fee after the license is issued.
Certified copies of the marriage certificate cost $10 each. Order them from the Clayton County Probate Court in person or by mail. For state-level records from June 1952 through August 1996, contact the Georgia Department of Public Health.
After Your Wedding
The officiant signs the license after the ceremony. Return it to the Clayton County Probate Court within 30 days. Mail or hand-deliver the signed form. The court records the license and mails your marriage certificate. This usually takes up to 30 days.
If more than 45 days pass without getting your certificate, call the Probate Court at (770) 477-3305. Ask the staff to check on the status. The most common issue is a missing signature from the officiant.
